These terms apply to your use of Klaq (the iOS and Android app and the server behind it, together the "Application"), run by Gabriel Henrique Silva ("we"), an individual established in Brazil. By creating an account or using the Application, you agree to these terms and to the Privacy Policy.
What Klaq is
Klaq is a diary for what you watch and read: movies, series, episodes and books, with progress, ratings, lists, statistics and social features (profile, following people, activity feed, reviews and replies). The Application is free and under active development: features may change, be added or be removed, and some versions are distributed as a beta.
Your account
- You must be 16 or older to use the Application, or have your guardians' consent where the law requires it.
- Use an email address that belongs to you and keep your password secret. You are responsible for what is done with your account.
- The name and @username you choose must not impersonate anyone or infringe anyone's rights.
- You can delete your account at any time (see Delete account).
License to use
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use the Application on your devices, for personal, non-commercial use. You may not copy, resell or modify the Application, reverse engineer it (except where the law allows), or use bots or scripts to access the service or collect other people's data.
Catalog data
Movie and series information and images come from TMDB. Book information comes from Google Books, Open Library and BrasilAPI. This product uses the TMDB API but is not endorsed or certified by TMDB. We don't guarantee that this information is complete or correct, and the trademarks, posters and covers belong to their owners.
Your content
Your logs, ratings, lists, bookshelf, reviews and replies remain yours. So the Application can work, you grant us a free, non-exclusive, worldwide license to store, copy, display and adapt that content within the Application (for example, showing your review on a movie's page or on your profile) while it is published. The license ends when you delete the content or your account, except for backup copies kept for the period described in the Privacy Policy. We don't sell or sublicense your content to third parties.
What other people can see depends on your account's privacy setting. Reviews and replies are always public to anyone signed in.
Community rules
Reviews and replies are public. When you post, you agree to:
- be respectful: no insults, harassment, threats, hate speech or discrimination;
- not post sexual content, graphic violence or illegal content;
- not spam, advertise or scam, or post malicious links;
- not expose anyone's personal data without consent;
- not impersonate anyone;
- respect copyright;
- mark spoilers.
Moderation
To keep the community healthy, the Application has these safeguards:
- Automatic filter: text with banned terms is not published.
- Posting limit: up to 5 posts per minute and 100 per day.
- Reports: anyone can report a review or reply (spam, harassment, unmarked spoiler or another reason). When 3 different people report the same content, it is hidden until a moderator reviews it.
- Human review: moderators review reports and decide whether to keep or remove the content.
- Blocking: you can block anyone. A block hides each person's content from the other, both ways.
- Bans: people who break the rules seriously or repeatedly may be banned. A banned account can no longer post, and its reviews and replies stop showing to others.
If you think a moderation decision was a mistake, email [email protected] explaining the case. We reply within a reasonable time, with the reason for the final decision.
Illegal content or content that infringes your rights can also be reported at the same address, with enough information to identify it.
Notifications
If you allow it, the Application sends push notifications about new followers, accepted requests, replies to your reviews and Klaq news. You can turn them off at any time in the app or in your device settings.
Supporting the project
Voluntary contributions help keep Klaq running, but they don't buy features, perks or different treatment in the Application, and they don't create an obligation to keep the service running for any set period.
Intellectual property
The Application, its code, design, name, icons and brand belong to us. These terms don't give you any right to use the Klaq brand.
Suspension and termination
- We may suspend or terminate accounts that break these terms or the law, or that put other people or the service at risk. Except in serious or urgent cases, we warn you by email first.
- You can stop using the Application and delete your account whenever you want.
- We may shut down the Application. If that happens, we will give reasonable notice.
Availability and liability
The Application is provided as is, without any guarantee that it will work without interruptions or errors. Some features need an internet connection, and mobile data use may incur charges from your carrier. To the extent permitted by law, we are not liable for indirect damages or for data loss caused by factors outside our control. Nothing in these terms limits rights you have under the Brazilian Consumer Defense Code or any other law that cannot be waived by contract.
Governing law and jurisdiction
These terms are governed by the laws of Brazil. Any dispute will be settled in the courts of your place of residence, as provided by the Consumer Defense Code.
Changes to these terms
We may update these terms when the Application changes. The effective date is shown at the top of the page. Relevant changes will also be announced in the app. Continuing to use the Application after a change means you accept the new version.
